Abstract

In the area of civil jurisdiction, the Discovery system will be implemented, making it necessary to explore or analyze its effectiveness and impact by reviewing rules, procedures, strategies, and potential obstacles. In this regard, the Civil Procedure Code was reviewed to identify these barriers or potential drivers that the establishment of the disclosure of evidence may have. A comparative study was conducted between the Anglo-Saxon jurisdiction, maritime proceedings, and civil proceedings in Panama, examining the similarities, distinctions, and benefits of Discovery as established by Law No. 402 of 2023. Through the research, the benefits this technique can add to national civil proceedings were discovered, improving transparency and fairness in the collection of evidence. This was a mixed, descriptive, non-experimental study, which involved a survey of a group of legal professionals to assess perceptions on this matter. One of the relevant conclusions of this study was that, according to the survey, 71% of the participants believed that it is crucial to start training and updating programs so that lawyers can effectively master the Discovery system.
